1. ELIGIBILITY REQUIREMENTS: Open to legal residents of the fifty (50) United States and the District of Columbia who are 21 years of age or older at the time of entry. Employees, contractors, directors and officers of Blue Diamond Growers ("Sponsor"), its parent, subsidiary and affiliated companies, retailers, distributors, licensees, manufacturers, web design, advertising, fulfillment, judging and promotion agencies involved in the administration, development, fulfillment and execution of this Promotion, and Ladies Professional Golf Association ("LPGA") (collectively, "Promotion Parties"), and the immediate family members of each (spouse, parent, child, sibling, grandparent, and spouse or "step" of each) and those living in the same household (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Promotion) are not eligible to participate. Promotion subject to federal, state and local laws and regulations.
2. PROMOTION PERIOD: Promotion begins on 4/1/09 at 12:00:00 am Pacific Time ("PT") and ends on 8/25/09 at 11:59:59 pm PT (the "Promotion Period"). The clock for the Web Site server is the official clock for this Promotion.
3. TO ENTER: Log on to www.bluediamondsportsnut.com ("Web Site") during the Promotion Period. Follow the on-screen directions to complete and submit the online registration form. For your registration to be valid, you must complete all required information and click on the "Submit" button on the registration page. You will be required to enter a UPC from the back panel of a Blue Diamond® product, or you may also request a UPC without making a purchase by clicking on the "UPC Code" request link on the Web Site during registration, which will immediately generate a valid UPC for you on your registration form. Once you have registered on the Web Site you do not need to register again each time you visit the Web Site. You can enter the Promotion as a returning user and only enter your e-mail address that you previously registered with when prompted to obtain your entry/game play for that Day. Once registered, you will be given the opportunity to play the online weekly instant win game and enter the grand prize drawing ("Grand Prize Drawing"). Upon playing the weekly instant win game, you will be instantly notified whether you have won a weekly prize pack ("Weekly Prize Pack") (see Section 5 below for the Weekly Prize Pack description), subject to verification. Automated means of entry are prohibited. Whether or not you are a Weekly Prize Pack winner, you will receive one (1) entry for a chance to win the Grand Prize each time you play. Limit one (1) game play/entry per person, household, and/or email address per Day of the Promotion Period. A "Day" is defined as the 24 hours between 12:00:00 am PT and 11:59:59 pm PT throughout the Promotion Period. All entries must be received by 11:59:59 pm PT on 8/25/09.
4. GRAND PRIZE DRAWING: One (1) Grand Prize winner will be selected in a random drawing from all eligible entries received. Odds of winning the Grand Prize depend on the number of eligible entries received. Drawing will be conducted on or about 9/3/09 by Marketing Resources, Inc., an independent judging organization ("Judges"), whose decisions shall be final and binding on all matters relating to the Promotion. By participating, entrants agree to abide by and be bound by these Official Rules and the Judges' decisions.
ONE (1) GRAND PRIZE: A trip for a verified winner and one (1) guest ("Guest") to Maui, HI for the 2009 Kapalua LPGA Classic ("Grand Prize"). Grand Prize includes: round-trip coach air transportation from a major commercial gateway airport near winner's residence within the United States to Maui, HI; seven (7) days/six (6) nights of hotel accommodations which includes one (1) hotel room with double occupancy; seven (7) days of car rental; LPGA to provide two (2) tournament credentials to the 2009 Kapalua LPGA Classic; LPGA to provide two (2) tickets to the Friday Night Awards Party being held on 10/16/09; LPGA to provide two (2) 2009 Kapalua LPGA Classic VIP "Inside The Ropes" passes to be used on 10/17/09; one (1) dinner cruise for two (2) to be selected by Sponsor; a $500 spa credit; and $500 in spending money payable to the winner in the form of a pre-paid Visa gift card. Gift card is subject to the terms set by the issuer. Approximate Retail Value ("ARV") of Grand Prize is $7,070. Rental car portion of prize is subject to terms and conditions of the rental car company, and winner will be responsible for any costs related to use of rental car, including gas and insurance. If winner is not eligible to rent a car based on the rental car company's eligibility criteria, as determined by the rental car company in its sole discretion, this portion of the Grand Prize will not be awarded. Actual value of Grand Prize may vary depending on winner's point of travel origin, airfare and hotel fluctuations. Any difference between the stated ARV and the actual value of the Grand Prize will not be awarded. Airport, airline, hotel accommodations, ground transportation and/or tickets for the Grand Prize are to be selected by Sponsor. All meals, gratuities, luggage fees, incidental hotel charges and other expenses associated with Grand Prize not specifically mentioned in these Official Rules are the winner's responsibility. All travel must be taken on dates to be specified by Sponsor at the time of winner notification (currently expected to be between 10/13/09 and 10/20/09) or prize will be forfeited. Winner and winner's Guest must travel on same itinerary and no changes can be made to the itinerary once trip is scheduled. Winner and winner's Guest are responsible for obtaining all documents required for travel (e.g., valid government issued ID). A minor may take the trip as a Guest only if the winner is the minor's parent or legal guardian. Winner and/or Guest's participation in any or all activities in connection with the Grand Prize is voluntary. In the event that winner and/or winner's Guest elects not to participate in any or all designated activities for the Grand Prize, winner will be afforded no additional compensation in exchange. A minor going on the trip as the Guest of the winner must be accompanied by a parent or legal guardian at all times.
5. WEEKLY INSTANT WIN GAME: This is not a game of skill. Winners will be instantly notified upon submitting a game play on the Web Site whether or not they have won a Weekly Prize Pack, subject to verification. One Weekly Prize Pack will be randomly awarded each week of the Promotion Period (as outlined below). The Judges will determine, at random, the times at which Weekly Prize Packs will be awarded throughout each Weekly Entry Period. The first participant to play the weekly instant win game on or after the time randomly determined by the Judges will be deemed the Weekly Prize Pack Winner (subject to verification). The odds of winning a Weekly Prize Pack are based upon the number of eligible entries received and the time at which they are received. No more than the stated number of Weekly Prize Packs will be awarded for any reason. If you win a Weekly Prize Pack you are still eligible to win the Grand Prize.

6. GENERAL CONDITIONS: All federal, state and local taxes are the sole responsibility of the Grand Prize winner, and Grand Prize winner will receive an IRS Form 1099 for the value of the prize. No cash equivalent or substitution of any prize is offered, except as provided herein and at the sole discretion of the Sponsor. No transfer of prize. By participating, entrants agree to these Official Rules and Sponsor's Privacy Policy (available at www.bluediamondsportsnut.com) which are final and binding in all respects. Unclaimed prizes will not be awarded. Grand Prize winner will be notified by mail and will be required to complete, sign and return an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release within five (5) days of attempted notification or prize may be forfeited. Guest of Grand Prize winner must also sign a Liability/Publicity Release Form within five (5) days of notification. If Guest is a minor, winner must be his/her parent/legal guardian who must sign all required documents on behalf of minor. Neither Sponsor nor the Promotion Parties are responsible for any typographical or other error in the printing, the offering or the announcement of any prize or in the administration of the Promotion. Weekly Prize Packs will be shipped within 4 to 6 weeks of end of Promotion Period. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. If, in the Judges' opinion, there is any suspected evidence of tampering with any portion of the Promotion, or if technical difficulties compromise the integrity of the Promotion, or for any reason the Promotion is not capable of running as planned including fraud or other causes which corrupt or affect the administration, security, fairness or proper conduct of the Promotion, the Sponsor reserves the right to disqualify any individual who is responsible or who tampers with the entry process, or to modify or terminate the Promotion in a manner deemed reasonable by the Sponsor, at the Sponsors' sole discretion. In the event of termination, all prizes will be awarded in a random drawing from all entries received as of the time of termination. This Promotion is offered only in the United States and is governed by the laws of the state of California, and all claims must be resolved in the federal or state courts of Sacramento County, California.
7. LIMITATIONS OF LIABILITY AND RELEASE: All entrants must have a valid e-mail address. In the event a dispute arises as to the identity of a potentially winning online entrant, entries made by Internet will be declared made by the name on the online registration form. All federal and state laws apply. No more than the advertised number of Weekly Prize Packs will be awarded. If due to a computer programming or other error, or for any other reason, more Weekly Prize Packs are claimed than intended to be awarded according to Section 5 above, Weekly Prize Packs will be awarded in a random drawing from among all Weekly Prize Pack claims received. In no event will Sponsor be liable for more than the stated number of Weekly Prize Packs in Section 5 above. Sponsor's sole liability for defective weekly instant win game play is to allow one additional game play during the Promotion Period. Sponsor and Promotion Parties are not responsible for errors of any kind, whether human, mechanical or electronic, including without limitation, the incorrect or inaccurate capture of entry information online regardless of cause that may limit a user's ability to participate in the Promotion. No liability or responsibility is assumed by Sponsor or Promotion Parties resulting from user's participation in, attempt to participate in the Promotion, download of any information in connection with participating in the Promotion. Neither Sponsor nor Promotion Parties are responsible for any typographical errors in these Official Rules, or any inaccurate or incorrect data contained on the Web Site. Use of Web Site is at user's own risk. Sponsor and the Promotion Parties are not responsible for any personal injury or property damage or losses of any kind that may be sustained to user's or any other person's computer equipment resulting from participation in the Promotion, use of the Web Site or the download of any information from the Web Site. By participating in the Promotion, the entrant thereby releases Sponsor and the Promotion Parties from any and all claims, damages or liabilities arising from or relating to such entrant's participation in the Promotion. By accepting a prize, winner agrees to release and hold Sponsor and Promotion Parties, and all of their respective officers, directors, employees, representatives and agents harmless from and against, any liability for injuries, losses or damages of any kind to persons or property resulting in whole or in part, directly or indirectly, from participation in the Promotion; from acceptance, possession, misuse or use of a prize; and any liability for taxes, duties or other levies assessed upon any of the prizes. Except if winner is a resident of Tennessee, or where prohibited by law, by accepting prize, winner grants permission for Sponsor and those acting under its authority, and the LPGA, to use his/her name, photograph, voice and/or likeness, for advertising and/or publicity purposes, in any and all media now known or hereinafter invented without territorial or time limitations and without additional compensation.
